Welcome to 2lemon.ch (“we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of our website and online shop located at www.2lemon.ch (the “Site”) and the purchase of our products. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use our Site.

  1. Scope of Application

These Terms apply to all orders and contracts concluded between 2lemon and customers (“you” or “customer”) concerning the products offered on our Site. They also apply to all future transactions, even if not expressly agreed upon again.

  1. Products

4.1 Early Development Stage
Our wooden deck chairs are currently in an early development phase. They are crafted from upcycled canopies like parachutes, paragliders, and kites, making each piece unique.

4.2 Testing and Certification
Due to the innovative nature of our products and the use of upcycled materials, they may not have undergone the same level of testing or certification as products from established furniture manufacturers.

4.3 Product Safety
We are committed to providing safe and high-quality products. While we take care to ensure the safety and durability of our deck chairs, we advise customers to be aware of their developmental status.

4.4 Customer Responsibility
By purchasing our products, you acknowledge that they are in an early stage of development and agree to use them responsibly and according to any provided instructions.

  1. Ordering and Contract Conclusion

5.1 Product Selection
You can select products from our assortment and place them in a shopping cart using the “Add to cart” button.

5.2 Order Process
By clicking the “Place order” button, you submit a binding offer to purchase the products in your cart. Before submitting the order, you can review and modify your order details at any time.

5.3 Order Confirmation
Upon receipt of your order, we will send you an email confirming the receipt of your order (“Order Confirmation”). This Order Confirmation does not constitute acceptance of your offer but serves to inform you that your order has been received.

5.4 Contract Formation
A binding contract is formed only when we accept your order by sending a separate email confirming the dispatch of the products (“Shipping Confirmation”) or by delivering the products to you.

  1. Prices and Payment Terms

6.1 Prices
All prices are in Swiss Francs (CHF) and include the statutory Value Added Tax (VAT) applicable in Switzerland. Shipping costs are not included in the product prices and will be displayed separately during the ordering process.

6.2 Payment Methods
We accept the following payment methods:

  • Bank Transfer

6.3 Payment Terms
Payment is due immediately upon conclusion of the contract. Products will only be shipped after receipt of full payment.

  1. Delivery and Shipping

7.1 Delivery Area
We currently deliver exclusively within Switzerland.

7.2 Delivery Times
The estimated delivery time is indicated on the product page. While we strive to meet these delivery times, they are not guaranteed.

7.3 Shipping Costs
Shipping costs are calculated based on the weight and size of the products and will be displayed during the checkout process.

7.4 Transfer of Risk
The risk of accidental loss or deterioration of the products passes to you upon delivery.

  1. Retention of Title

We retain ownership of the products until full payment of the purchase price has been received.

  1. Right of Withdrawal and Returns

9.1 Right of Withdrawal
Due to the personalized and handcrafted nature of our products, we do not offer a general right of withdrawal.

9.2 Defective Products
If the product is defective or does not conform to the contract, please contact us within 5 days of receipt at info@2lemon.ch with a description and photographic evidence of the issue.

9.3 Returns Process
If a return is authorized, we will provide instructions for returning the product. Unauthorized returns will not be accepted.

9.4 Refunds and Replacements
Upon receipt and inspection of the returned product, we will, at our discretion, repair, replace, or refund the purchase price, including any shipping costs. We also reserve the right to offer a partial refund (minderung) while allowing you to keep the product, in cases where this remedy is deemed appropriate.

  1. Warranty and Liability

10.1 Warranty Period
We provide a warranty for material and manufacturing defects of newly produced parts for a period of two years from the date of delivery. This warranty does not apply to components made from upcycled materials.

10.2 Exclusions
The warranty does not cover normal wear and tear, improper use, or lack of care and maintenance.

10.3 Limitation of Liability
Our liability is governed by the applicable legal provisions. However, we shall not be liable under any circumstances for slight negligence, indirect or consequential damages, lost profits, unrealized savings, damages resulting from delivery delays, or any acts or omissions by our auxiliary persons, whether contractual or non-contractual.

We exclude all liability, without limitation, for any losses or damages of any kind—whether direct, indirect, or consequential—that arise from the use of our products, from the use of or access to our website, or from links to third-party websites. We do not guarantee that all parts of our website will function error-free, and we disclaim any liability for unauthorized manipulation of users’ IT systems.

  1. Customer Obligations

11.1 Account Information
You are responsible for ensuring that the information you provide is accurate and up-to-date.

11.2 Password Security
If you create an account, you are responsible for maintaining the confidentiality of your password and account.

11.3 Prohibited Uses
You agree not to misuse the Site or our products for unlawful purposes or in a way that could damage our reputation.

  1. Intellectual Property

All content on the Site, including text, graphics, logos, images, and software, is the property of 2lemon or its content suppliers and is protected by intellectual property laws. Unauthorized use is prohibited.

We process your personal data in accordance with our Privacy Policy, which is an integral part of these Terms.

  1. Force Majeure

We are not liable for any failure or delay in performing our obligations where such failure or delay results from any cause beyond our reasonable control, including natural disasters, pandemics, strikes, wars, or governmental action.

  1. Amendments to the Terms

We reserve the right to modify these Terms at any time. The current version is available on our Site. Changes do not apply to orders that have already been placed.

  1. Severability Clause

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain unaffected and continue in full force and effect.

  1. Governing Law and Jurisdiction

This contract and its interpretation and enforceability shall be governed by Swiss substantive law to the exclusion of international conventions, including the United Nations Convention on Contracts for the International Sale of Goods of April 11, 1980 (CISG), and to the exclusion of conflict of laws rules. The exclusive place of jurisdiction is Düdingen, Switzerland.
